Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, services, and products provided by KG Creative DOO ("KG Creative", "we", "us", or "our"), a company registered in Montenegro at UL. Hercegovacka br. 80, Podgorica 81000. By accessing our website or engaging us for services, you agree to be bound by these Terms.

1. Services

KG Creative provides software development services including, without limitation, iOS mobile application development, infrastructure operation and maintenance, and artificial intelligence integration. The specific scope, deliverables, timeline, and fees for each engagement will be set out in a separate written agreement, statement of work, or proposal ("Project Agreement") between KG Creative and the client.

2. Use of the Website

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of it. Prohibited activities include attempting to gain unauthorised access to any portion of the website, interfering with its proper operation, or using it to distribute malware or other harmful content.

3. Intellectual Property

Unless otherwise agreed in a Project Agreement, all content on our website — including text, graphics, logos, code, and design — is the property of KG Creative or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any such content without our prior written permission.

Ownership of deliverables produced for clients under a Project Agreement will be determined by the terms of that agreement.

4. Fees and Payment

Where services are provided on a paid basis, the client agrees to pay all fees as set out in the applicable Project Agreement. Invoices are due within the period specified on the invoice. Late payments may result in the suspension of services and may accrue interest at the maximum rate permitted by applicable law.

5. Client Responsibilities

The client agrees to:

• Provide accurate information and the materials reasonably required for the project;
• Respond to requests for feedback and approvals within reasonable timeframes;
• Hold the necessary rights and permissions for any content, trademarks, or data supplied to KG Creative;
• Comply with all applicable laws in the use of deliverables.

6. Confidentiality

Each party agrees to treat as confidential any non-public information shared during an engagement and to use such information solely for the purposes of performing the services. This obligation survives termination of the Project Agreement.

7. Warranties and Disclaimers

We provide our services with reasonable skill and care. However, our website and any informational content on it are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by applicable law, KG Creative shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of our website or services. Our total aggregate liability in respect of any engagement shall not exceed the fees paid by the client to KG Creative for the services giving rise to the claim during the three (3) months preceding the event that gave rise to liability.

9. Indemnification

You agree to indemnify and hold harmless KG Creative, its directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of our services.

10. Termination

We reserve the right to suspend or terminate your access to our website at any time and without notice if we believe you have violated these Terms. Termination of any Project Agreement is governed by the terms of that agreement.

11. Third-Party Services

Our services may integrate with or rely on third-party platforms, APIs, and services (such as cloud providers, Apple's App Store, or AI model providers). We are not responsible for the availability, content, or practices of such third parties, and your use of them may be subject to their own terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Montenegro, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Podgorica, Montenegro, unless otherwise agreed in writing.

13. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of our website after any changes become effective constitutes your acceptance of the revised Terms.
